Our Terms of Service at ESG Workplace

The following Terms of Service (“Terms”) govern your access to and use of the ESG Workplace website and any associated services (collectively, the “Platform”) provided by ESG Workplace (“we,” “us,” or “our”). By using the Platform, you agree to these Terms, including additional policies referenced herein, such as our Privacy Policy. If you do not agree, you must not use the Platform.

1. Eligibility
The Platform is intended for users who are at least 18 years old. By using ESG Workplace, you represent that you are of legal age to enter into binding agreements and are not subject to any sanctions or restrictions under applicable laws, including those of the United States and the European Union.
2. Definitions
- Users: Refers to all visitors to the Platform, including Buyers and Sellers.
- Buyers: Users who purchase services via the Platform.
- Sellers: Users who offer services for hire on the Platform.
- Orders: Agreements between Buyers and Sellers for services purchased through the Platform.
- Disputes: Conflicts between Buyers and Sellers that require mediation by ESG Workplace.
3. Account Registration
To access the full range of services, you must register an account and provide accurate, complete, and current information. Users are responsible for maintaining the confidentiality of their accounts and passwords.
4. Seller Responsibilities
4.1 Service Listings
- Sellers must provide accurate descriptions of their services and associated costs.
- Services offered must comply with all applicable laws and not infringe third-party rights.
4.2 Delivery and Performance
- Sellers are obligated to complete Orders within the agreed-upon timeframes.
- Failure to deliver services as promised may result in penalties, including suspension or removal of the Seller’s account.
5. Buyer Responsibilities
Buyers are required to:
- Clearly communicate project requirements.
- Make payments promptly via the Platform.
- Refrain from soliciting or accepting services outside of ESG Workplace to circumvent fees.
6. Payment Terms
- Payments are processed securely through third-party payment providers.
- ESG Workplace collects a service fee from Sellers, detailed at the time of account setup.
- Refunds are subject to our dispute resolution process and will be issued at our sole discretion.
7. Ownership and Licensing
- Upon full payment, Buyers receive ownership of deliverables unless explicitly stated otherwise.
- Sellers retain the right to display work samples in their portfolios unless the Buyer explicitly requests otherwise.
8. Prohibited Conduct
Users agree not to:
- Use the Platform for any unlawful purposes.
- Submit false or misleading information.
- Circumvent fees, violate intellectual property rights, or engage in abusive behavior.
9. Dispute Resolution
9.1 Process Disputes between Buyers and Sellers will first be addressed through our Resolution Center. If unresolved, ESG Workplace may mediate or provide a binding resolution.
9.2 Fees and Liability ESG Workplace is not responsible for the quality or legality of services provided. Our liability is limited to the fees collected for the disputed Order.
10. Termination
We may suspend or terminate user accounts for violations of these Terms or any policies referenced herein. Users may deactivate their accounts by contacting Customer Support, but outstanding payment obligations remain enforceable.
11. Indemnification
Users agree to indemnify ESG Workplace against any claims arising from their use of the Platform, including but not limited to intellectual property disputes, breach of these Terms, or negligence.
12. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on the Platform and are effective immediately upon posting. Continued use of the Platform signifies acceptance of the revised Terms.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts located in Delaware, USA.
14. Miscellaneous
14.1 Severability: If any part of these Terms is deemed unenforceable, the remaining provisions remain in full effect.
14.2 Entire Agreement: These Terms constitute the entire agreement between you and ESG Workplace.
